{"id":90248,"date":"1999-12-31T00:17:00","date_gmt":"1999-12-30T13:17:00","guid":{"rendered":"http:\/\/smartoffice.com.au\/accc-put-murdoch-family-on-notice-over-ten-tv-network\/"},"modified":"1999-12-31T00:17:00","modified_gmt":"1999-12-30T13:17:00","slug":"accc-put-murdoch-family-on-notice-over-ten-tv-network","status":"publish","type":"post","link":"https:\/\/staging.strixdevelopment.net\/smartoffice\/1999\/12\/31\/accc-put-murdoch-family-on-notice-over-ten-tv-network\/","title":{"rendered":"ACCC Put Murdoch Family On Notice Over TEN TV Network"},"content":{"rendered":"<p>The Australian Competition and Consumer Commission could still have the final say in whether Foxtel and the Murdoch family get control of the Ten TV Network.<\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 10pt;\">ACCC Chairman Rod Sim has apparently put the Murdoch family<\/p>\n<p>who own 50% of Foxtel on notice that all of their local media interests will be<\/p>\n<p>taken into account in his ruling on the controversial deal between News Corp&#8217;s<\/p>\n<p>pay-television venture Foxtel and Ten Network Holdings, according to the<\/p>\n<p>Financial Review<\/span><\/p>\n<p class=\"MsoNormal\">&#8220;We will take a holistic look to try and understand<\/p>\n<p>what influence News and or Foxtel could have over Channel Ten that would be a<\/p>\n<p>level of influence beyond the 15 per cent direct shareholding that Foxtel would<\/p>\n<p>have,&#8221; the Australian Competition and Consumer Commission chairman told<\/p>\n<p>Fairfax Media.<\/p>\n<p class=\"MsoNormal\">His comments indicate that the ACCC will consider News&#8217;s 50<\/p>\n<p>per cent stake in Foxtel as well as News Corp co-chairman Lachlan Murdoch&#8217;s 8.5<\/p>\n<p>per cent stake in Ten through his private investment vehicle Illyria, which<\/p>\n<p>also owns radio company Nova Entertainment.<\/p>\n<p class=\"MsoNormal\">His comments are a serious concern for both Ten shareholders<\/p>\n<p>and the Murdoch family.<\/p>\n<p class=\"MsoNormal\">A decision on the proposed deal is due by September 10.<\/p>\n<p class=\"MsoNormal\">Of major concern to the ACCC is whether the combination of<\/p>\n<p>shares give News and Foxtel effective control over Ten a move that could<\/p>\n<p>substantially lessen competition in the market for sports rights and other<\/p>\n<p>content.<\/p>\n<p class=\"MsoNormal\">Telstra owns the other 50 per cent of Foxtel.<\/p>\n<p class=\"MsoNormal\">Fairfax said that it is Mr Sims&#8217; first public commentary on<\/p>\n<p>the complex deal announced last month which will reshape the local media<\/p>\n<p>landscape through the sale of 15 per cent of free-to-air broadcaster Ten to<\/p>\n<p>Foxtel, who&#8217;s Multi-Channel Network will take control of the network&#8217;s<\/p>\n<p>advertising sales. Ten will acquire 24.99 per cent of MCN.<\/p>\n<p class=\"MsoNormal\"><\/p>\n<p class=\"MsoNormal\">&#8220;We are conscious that one of the News Corp executives<\/p>\n<p>(Lachlan Murdoch) has a shareholding (in Ten) separately and we will bear that<\/p>\n<p>in mind in our assessment of these things,&#8221; said Mr Sims. &#8220;It is too<\/p>\n<p>early to say yet what our view will be but clearly the higher the level of<\/p>\n<p>shareholding the more likely it is that there will be greater control.<\/p>\n<p class=\"MsoNormal\"><\/p>\n<p class=\"MsoNormal\">&#8220;There&#8217;s no doubt that you can&#8217;t ignore these things.<\/p>\n<p>You can&#8217;t be mechanical about this. You have to take common sense view of what<\/p>\n<p>the various ownership stakes mean.&#8221;<\/p>\n<p class=\"MsoNormal\"><\/p>\n<p class=\"MsoNormal\">Mr Sims, warned News Corp three years ago that it would<\/p>\n<p>struggle to get approval for any expansion into free-to-air television.<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">He believes that control of Sports rights is the key issue.<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">In 2012 Mr Sims blocked Kerry Stokes&#8217;s Seven Group&#8217;s effort<\/p>\n<p>to get hold of 50 per cent of Fox Sports through the acquisition of James<\/p>\n<p>Packer&#8217;s Consolidated Media Holdings. <o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">The ACCC had voiced concerns that Seven&#8217;s free-to-air<\/p>\n<p>rivals, Nine and Ten, would be disadvantaged in bidding for sports rights if<\/p>\n<p>Seven also owned half of Fox Sports.<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">Mr Sims said that Foxtel&#8217;s move was &#8220;very<\/p>\n<p>different&#8221; to Seven&#8217;s and it was taking a smaller stake, but added:<\/p>\n<p>&#8220;There&#8217;s no question that in the Channel Seven\/Fox Sports matter our<\/p>\n<p>concern was largely around sports rights and there is no question that thinking<\/p>\n<p>is in our minds now.&#8221;<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">Any free-to-air network needs to work closely with Foxtel in<\/p>\n<p>winning sports rights because it is the richest company, making almost $1<\/p>\n<p>billion a year in underlying profit, more than the three metropolitan<\/p>\n<p>free-to-air networks combined.<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><o_p>&nbsp;<\/o_p><\/p>\n<p class=\"MsoNormal\">Mr Sims acknowledged that the market for video content has<\/p>\n<p>changed since 2012, an argument Foxtel is likely to make, noting the explosion<\/p>\n<p>of competition for content, including from overseas multinationals such as<\/p>\n<p>Netflix.<o_p><\/o_p><\/p>\n<p class=\"MsoNormal\"><a href=\"http:\/\/www.afr.com\/brand\/murdochs-on-notice-over-foxtel-grab-for-ten-20150726-gii9by\">See full story here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Australian Competition and Consumer Commission could still have the final say in whether Foxtel and the Murdoch family get control of the Ten TV Network.<\/p>\n","protected":false},"author":67,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"gallery","meta":{"footnotes":""},"categories":[28,51],"tags":[],"class_list":["post-90248","post","type-post","status-publish","format-gallery","hentry","category-archive","category-marketing","post_format-post-format-gallery"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 -
